Terms of Service

Please read these Terms of Service carefully before using Privé. By downloading or using the app, you agree to these terms.

1. Acceptance of Terms

By downloading, installing, or using Privé ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not download or use the App.

2. License

Privé grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices you own or control, subject to these Terms and the Apple App Store Terms of Service.

3. Free and Pro Tiers

The App is available in a free tier with limited storage (15 media items, 3 notes, 5 contacts, 2 ID cards) and a Pro tier available as a one-time in-app purchase of $5.99 USD, which unlocks unlimited storage and Face ID unlock. All purchases are final and processed by Apple. Refund requests are subject to Apple's refund policy.

4. User Responsibilities

You are solely responsible for your secret PIN and for all content stored in your vault. Privé has no ability to recover lost PINs or access your encrypted data. You agree not to use the App for any unlawful purpose or to store content that violates any applicable law, including but not limited to content that infringes intellectual property rights or contains illegal material.

5. Intellectual Property

All content, design, code, branding, and materials within Privé are owned by Privé App and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works based on any part of the App without express written permission.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied. While we implement strong on-device AES-256 encryption, no security system is guaranteed to be infallible. Privé App makes no warranty that the App will meet your requirements or be available uninterrupted, timely, secure, or error-free.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Privé App and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or unauthorized access, arising out of or related to your use of or inability to use the App, even if Privé App has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold harmless Privé App and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the effective date above when changes are made. Continued use of the App after changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in California.
